Citizenship by descent changed in 2025, and the change stands

Since March 28, 2025 (Decree-Law 36/2025, converted into Law 74/2025), a person born abroad who holds another citizenship no longer acquires Italian citizenship by descent automatically. Italy’s Constitutional Court rejected the first challenges on March 12, 2026, and in June 2026 referred a further question to the Court of Justice of the European Union. Until that court rules, the law applies in full.

Cases that still work, in broad terms:

  • an application or court case filed by 11:59 p.m. Rome time on March 27, 2025, now asking for documents;
  • a parent or grandparent who held only Italian citizenship;
  • a parent who lived in Italy for two consecutive years after becoming Italian and before your birth.
We are not Italian lawyers and we do not assess eligibility. If your case depends on how the law applies to you, get advice from an Italian lawyer or the consulate first. What we do is make sure that, once you file, the Canadian documents are exactly what the office asked for. We will not sell you a kit for a file that cannot be filed.

Italian citizens living in Canada (AIRE)

Every birth, marriage, divorce and death in Canada has to be transcribed into your comune’s records through the consulate. That needs the full Canadian record, apostilled, with an Italian translation. This is the largest group we serve for Italy, and it is untouched by the 2025 law.

Citizenship files still open

Applications filed before March 27, 2025, or cases that meet one of the remaining conditions. Typical requests: an ancestor’s Canadian naturalization record, marriage and death records, birth records for each generation, with names consistent across all of them.

Marrying in Italy

The comune and the consulate ask for recent civil status records and declarations. We apostille and translate the Canadian side, and tell you which declaration a Canadian notary can take.

Inheritance and property in Italy

Death records, proof of heirs, and a power of attorney so someone in Italy can act for you, signed before a Canadian notary, by video if you are abroad, then apostilled.

Full records, recent

Italian offices want the long-form record with parents’ names: the Québec copy of act, Ontario’s certified copy of registration. Many consulates also want it issued recently, often within six months. We order it to match your appointment.

Names that match across generations

Giuseppe on one record and Joseph on the next is a classic refusal. We flag inconsistencies at pre-check, and where a Québec record needs correcting, the route is on this page.

Translation in the accepted form

Some consulates certify translations themselves, others accept a sworn translation done in Italy (asseverata). We confirm with your receiving office and quote the Italian translation per page before you commit.

Common questions
Can I still get Italian citizenship by descent from Canada?
Only in narrower cases since Law 74/2025: an application filed by March 27, 2025, a parent or grandparent who held only Italian citizenship, or a parent who lived in Italy for two consecutive years before your birth. The Constitutional Court upheld the law in March 2026 and referred a question to the EU Court of Justice in June 2026; the law applies meanwhile. Eligibility is a legal question for an Italian lawyer or the consulate.
Does Italy accept Canadian apostilles?
Yes. Italy and Canada are both parties to the Apostille Convention, so one apostille from the correct Canadian authority replaces consular legalization.
Do Canadian documents for Italy need an Italian translation?
Yes, for almost every use. The accepted form varies: some consulates certify translations themselves, others accept a sworn translation done in Italy. We confirm the form with the receiving office and quote it per page.
How recent must the Canadian records be?
Many Italian offices want civil status records issued within the last six months. The receiving office sets the rule, so we order the record to match your appointment date.
